I could probably argue it - I did NOT use a picture of the shield, I used a free target gif and put my own star in the middle of it, and they certainly don't have copyright on 'say it ain't so'.

i think they definitely can copyright it, because it's recognizable as the symbol. If you change the colours and used green and orange then no, it's not Cap, but it's the symbol you used

Yeah. If you want to do parody and transformation you have to transform it ENOUGH, and the only way to know if you have for sure is to get sued and win
